These Terms and Conditions govern access to and use of the

website www.betterthannewbtn.com (hereinafter, the “Website”), which is owned and operated by Betterthannew.

By accessing or using the Website, users agree to be bound by these Terms and Conditions. Registration is not required to browse the Website or to make purchases. Placing an order implies express acceptance of these Terms.

Betterthannew offers mainly second-hand fashion products through the Website.

These Terms define the rights and obligations of Betterthannew and its users regarding the use of the Website and the purchase of products.

2. User Data

Users may purchase products through the Website as guests or, optionally, by creating an account. Users who create an account are responsible for maintaining the confidentiality of their login credentials and restricting access to their account. In the event of unauthorized access, the user must immediately notify Betterthannew.

All information provided must be accurate and up to date. Any modifications must be communicated to Betterthannew.

3. Orders and Sales Terms

Products offered on the Website are intended for individuals aged 18 or over. If the
user is under 18 years of age, parental or legal guardian consent is required to make a purchase.

The sales contract is considered concluded once Betterthannew sends the order confirmation email, provided that the product is available and payment has been authorized.

4. Prices, Payment Methods, and Discount Codes

All prices are in euros (€), include VAT, and, where applicable, handling and shipping fees.

Payment must be made using one of the methods specified on the Website. Once payment is confirmed, the user will receive an email summarizing the order.

Betterthannew may issue discount codes under specific conditions. Only one discount code may be used per order, and codes are not combinable with other promotions. In the event of an evident pricing or description error, Betterthannew reserves the right to cancel the order and refund the full amount paid.

5. Shipping Information

Orders are prepared and dispatched within 24 to 72 hours. Delivery times vary depending on the destination:

• Spain (mainland and the Balearic Islands): Free shipping for orders of 50€ or more. For orders under 50€, shipping is calculated at checkout. Delivery within 1–3 business days after dispatch.
• 15 EU countries (Austria, Belgium, Croatia, Czech Republic, Denmark, France, Germany, Hungary, Italy, Luxembourg, the Netherlands, Poland, Portugal, Slovakia and Slovenia): Free shipping for orders of 50€ or more. For orders under 50€, shipping is calculated at checkout. Delivery within 2–6 business days after dispatch.

6. Warranty, Returns, and Right of Withdrawal

6.1 Legal Warranty and Non-Conformity of Goods

In accordance with Directive (EU) 2019/771 and its transposition into Spanish law, all products commercialized by Betterthannew are covered by the statutory warranty of conformity. For goods categorized as second-hand, the minimum warranty period shall be one (1) year from the date of delivery, unless a longer period is expressly established.

The consumer is entitled, at no cost, to remedy any lack of conformity manifested during the warranty period. Such remedies may consist, at the consumer’s election and provided they are objectively feasible and not disproportionate, in either repair or replacement of the defective item. Where repair or replacement is impracticable, the consumer shall be entitled to a proportional reduction in the purchase price or to terminate the sales contract with restitution of the amounts paid.

Notification of lack of conformity must be sent to Betterthannew within two (2) months of the date on which the consumer became aware of the defect. Returned goods must be accompanied, to the extent reasonably possible, by original packaging, accessories, and documentation.

Refunds or other financial restitutions arising from the statutory warranty shall be executed within fourteen (14) calendar days following confirmation of the consumer’s entitlement and shall be effected via the same payment method used in the original transaction unless expressly agreed otherwise.

6.2 Right of Withdrawal

Users may withdraw from a purchase within 14 calendar days of receiving the product without giving any reason. To exercise this right, users must notify Betterthannew via contact@betterthannewbtn.com and return the product in the same condition as received, including tags, original packaging, and accessories.
Return shipping costs are borne entirely by the customer. Betterthannew may reduce the refund if the product is returned damaged or incomplete.

Refunds will include original shipping costs if the full order is returned. Partial returns will be refunded only for the items returned.

Refund processing times:

• 14 calendar days for card payments
• 24–48 business hours for PayPal payments
  Promotional Returns: For orders including promotional items (e.g., “buy 2 get 1 free”), all items within the promotion must be returned to exercise the right of withdrawal.

7. Product Exchanges

Direct product exchanges are not accepted. Users wishing to obtain a different item must process a return and place a new order.

8. Governing Law and Jurisdiction

These Terms and Conditions are governed by Spanish law.

• Consumers may bring disputes before the courts of their place of residence.
• Non-consumers (business users) are subject to the jurisdiction of the courts of Barcelona, Spain.
  Betterthannew also provides official complaint forms for customer use.

9. Intellectual Property

 

All content on the Website (text, images, logos, designs, etc.) is the property of Betterthannew or its licensors. Any reproduction, distribution, or use without prior
written authorization is prohibited.

10. Limitation of Liability
Nothing in these Terms limits Betterthannew’s liability for gross negligence, fraud, or any liability that cannot be excluded under applicable law.

Except in such cases, Betterthannew shall not be liable for indirect, incidental, or consequential damages, loss of profits, or loss of data arising from use of the Website or products purchased.

11. Final Provisions

If any clause of these Terms is held invalid, the remaining provisions shall continue in full force and effect.

Failure by Betterthannew to enforce any right shall not constitute a waiver.
In case of discrepancies between translated versions, the English version shall prevail.
